Legal malpractice is simply negligence of an attorney. An attorney, like any other professional, is judged by the standards of a reasonably qualified attorney engaged in his profession.
Examples of commonly litigated legal malpractice claims:
- An attorney fails to file a lawsuit within the defined time limits, called a “statute of limitations”
- An attorney fails to inform a client of conflicts of interest
- An attorney fails to investigate other claims or sources of recovery
- An attorney fails to properly investigate a claim or discover assets in a matrimonial case
