A “survival action” should not be confused with a “lost chance of survival” action. A survival action is a suit for the damages and injuries that the decedent could have brought suit for had they not died. For example, if the decedent survived for some days or weeks, a claim could be broughtfor medical bills and pain and suffering from the time of injury to death. A survival action is usually brought by the survivors along with a wrongful death action.
