Most state statutes define who can file suit for wrongful death by dividing surviving family into “classes.” The spouse and children of a deceased are always the primary class members and can both bring a suit and are entitled to damages. Parents and siblings may sometimes be proper parties. Additionally, some states require that a court-appointed Personal Representative bring such an action on behalf of these class members.
